Estonian Chamber of Commerce and Industry; Sales Terms of Online Store

The online shop koda.ee (hereinafter “the Online Store”) is owned by the Estonian Chamber of Commerce and Industry (hereinafter “the Chamber of Commerce”)

Validity of sales contract; commodity and price information

These sales terms apply to the purchase of goods and services from the Online Store.

An order submitted by the buyer is a purchase-sale contract between the Chamber of Commerce and the buyer. The Chamber of Commerce agrees to the contract when it starts to fulfil the order.

The prices of goods, contracts and services sold in the Online Store are marked beside the products.

The price may be supplemented by a charge for the delivery of the goods. The charge for the delivery of the goods depends on the buyer’s location and the method of delivery. The delivery charge is shown to the buyer when the order is formalised.

Information on the goods and services is provided in the Online Store directly at the goods or services.

Before registering for events organised by the Chamber of Commerce, it is mandatory for the buyer to examine the Terms of Participation.

Formalising an order

To order an item, the desired products must be added to the basket. In order to formalise the order, the required data fields must be filled in and the appropriate method of receiving the products must be selected. The amount of the charge payable is then displayed on the screen and can be paid through online banking or with another payment solution.

An order takes effect from moment the due amount is received on the bank account of Eesti Kaubandus-Tööstuskoda MTÜ.

If the service cannot be offered for any reason (e.g. the event is cancelled or delayed), the buyer shall be informed as soon as possible; if agreed so, the money paid shall be refunded immediately but no later than 7 days after the notification is sent.

If the goods ordered cannot be delivered due to the goods running out or for any other reason, the buyer shall be informed as soon as possible; if agreed so, the money paid (including the cost of delivery) shall be refunded immediately but no later than 7 days after the notification is sent.

Delivery of goods

Goods are only sent within Estonia.

The shipping costs of the items are borne by the buyer and the relevant price information is displayed with the selection of shipping methods.

Shipments generally reach the destination designated by the buyer within 3-7 working days of the entry into force of the order.

The Chamber of Commerce shall not be liable for delays and misunderstandings in the delivery of the goods if they are due to inaccuracy or incorrectness of the information provided by the buyer when the order is formulated.

Ordering Contract Bases

To order contracts, the buyer selects the contract. After that, the buyer enters his own contact information, an e-mail address, where the contract’s document file will be transmitted to, and selects the payment method. The members of the Chamber of Commerce shall be able to pay by means of online banking or an invoice issued. Before submitting the order, the buyer must check the terms of use of the service and tick the box to confirm that the buyer is familiar with the terms of use. The buyer will receive the contract base on his or her e-mail address immediately after payment of the invoice.

The buyer can obtain information on the charges for the various contracts at the website of the Chamber of Commerce before ordering the relevant contract.

Ordered contracts may be used for non-commercial purposes only and the reproduction, dissemination and otherwise transfer to third parties of the information contained therein without prior written consent by the Chamber of Commerce is prohibited.

Right of withdrawal for a natural person

The right of withdrawal shall not apply if the buyer is a legal person.

After receiving the order, the buyer being a natural person shall have the right to withdraw from the order in the e-shop within 14 days. In the case of an order concerning which the obligations of the Chamber of Commerce under the contract have been fully fulfilled at the time of withdrawal (e.g. the event has already taken place, the contract has been sent to the buyer’s e-mail address), provided that the consumer was aware in advance that he would lose his right of withdrawal upon the performance of the contract by the Chamber of Commerce.

If the goods have been used for purposes other than those necessary to verify the nature, characteristics and functioning of the goods or if the goods have signs of use or wear, the Online Store shall be entitled to lower the refundable charge according to the decrease in the value of the goods.

The cost of returning the goods shall be borne by the buyer unless the reason for the return is that the thing to be returned does not correspond to the order placed (for example, incorrect or defective items).

The buyer must return the goods within 14 days following the submission of the application or provide proof that he has delivered the goods to the carrier during the abovementioned period.

Upon receipt of the returned goods, the Online Store shall immediately, but not later than 14 days after receipt of the withdrawal application, return all charges received from the buyer under the contract.

The Online Store may refuse to make repayments until the item that is the subject of the contract has been recovered or until the buyer has provided evidence that he has returned the item, whichever comes first.

To return the goods, an application for withdrawal from the purchase of the goods must be submitted, the form of which can be found here: withdrawal application, sending it to the e-mail address koda@koda.ee no later than 14 days from the date of purchase.

Direct marketing; processing of personal data

Using the services of the Chamber of Commerce, you trust us with your personal information. We take the privacy of the data seriously and collect the data only to the extent necessary to use our services. We process personal data in accordance with the EU General Regulation on the Protection of Personal Data (GDPR, EU 2016/679) and the laws of the Republic of Estonia. The Chamber of Commerce shall not process sensitive personal data as defined in the GDPR Regulation.

The terms of processing personal data are laid down in the Terms of Data Protection of the Chamber of Commerce, which are an integral annex to these Terms of Sale. The Terms of Data Protection of the Chamber of Commerce explain how and why we collect and process personal data.

The online store uses personal information entered by the buyer (including name, phone number, address, e-mail address, bank requisites) only to process the order and to provide the service.

Estonian Chamber of Commerce and Industry is the responsible processor of personal data Estonian Chamber of Commerce and Industry transmits personal data which are necessary for making payments to the authorised processor Maksekeskus AS.

Dispute settlement

The Chamber of Commerce shall not be liable for a delay in the delivery of the order, the cancellation of the service or any damage caused to the buyer if the delay in the delivery, the cancellation of the service or the damage is due to circumstances that the Chamber of Commerce could not influence or foresee.

If the buyer has complaints regarding the Online Store, these must be sent by e-mail to koda@koda.ee .

If a natural person buyer and the Online Store are unable to resolve a dispute by agreement, the buyer will be able to contact the Consumer Disputes Committee. The Consumer Disputes Committee shall have the power to settle disputes arising from a contract concluded between a natural person buyer and the Online Store. Reviewing a complaint by natural person buyer in the Committee is free.
