Pursuant to § 5 of the Rules of Procedure, the Board of the Court of Arbitration shall approve and publish on its website a list of arbitrators, which is indicative for the election of arbitrators. The parties and their appointed arbitrators may also appoint an unlisted person who meets the requirements provided by law as an arbiter. The Board of the Court of Arbitration may also appoint a person who is not on the list as an arbiter.
ESTonIan ARBITRators who are judges
Pursuant to § 49 (2) (5) of the Courts Act, a judge may not be an arbiter elected by the disputing parties. This means that an incumbent judge can be elected as an arbitrator either by the arbitrators chosen by the parties or appointed by the Board of the Court of Arbitration of the Estonian Chamber of Commerce and Industry.
