Guidelines For The Assessment Of Arbitration Fees And Arbitrator Fees In The Arbitration Court Of The Estonian Chamber Of Commerce And Industry
1. The registration fee will be paid in Estonian kroons into the bank account of the Estonian Chamber of Commerce and Industry. The registration fee is EEK 1,200.00.
2. The amount of the arbitration fee shall be determined by the Arbitration Court Board according the following table and in light of the complexity of the case and the number of arbitrators involved in the settlement of the dispute.

3. The arbitration fee shall be deposited into the bank account of the Estonian Chamber of Commerce and Industry according to the procedure prescribed by the Article 12 of the Rules of the Arbitration Court in Estonian kroons or in any other currency determined by the Board of the Arbitration Court of the ECCI.
4. If the claim cannot be expressed in monetary value the Board of the Arbitration Court shall determine the amount of the arbitration fee proceeding from the nature of the dispute.
5. 10% of the remitted arbitration fees shall be transferred into the account of Estonian Chamber of Commerce and Industry.
6. The amount of an arbitrator fee is 75% (30% in case of 1 arbitrator) of the arbitration fee actually remitted according to § 12 of the rules and the present guidelines. Taxes prescribed by the law shall be deducted from the said amount when arbitrator fees are remitted. The arbitrator fee amounts are divided amongst arbitrators upon their agreement regarding which the Arbitration Court will submit an appropriate decree to the Arbitration Court Board.
7. The remainder of an arbitration fee will cover the other costs of the Arbitration Court, including reimbursement for the members of the Arbitration Court Board.
8. If an arbitrator reviewing a dispute does not live in Estonia, the Arbitration Court is entitled to collect from the party who designated the arbitrator a deposit to provide for the possible travel expenses of the arbitrator.
9. If a claim is awarded, the claimant shall be fully compensated for the expenses of arbitration fees or of the payment of the deposit specified in Article 7 at the expense of the respondent; if a claim is awarded partially, such compensation will be provided in proportion to the amount to be collected from the respondent according to the award.
10. If a claim not convertible into monetary value is partially awarded, the claimant shall receive compensation for the expenses related to the payment of arbitration fees, at the expense of the respondent and in an amount determined by the Arbitration Court.
11. If the proceedings of the Arbitration Court are discharged upon the approval by the Arbitration Court of a mutual out-of-court settlement between the parties or if the proceedings of the Arbitration Court are suspended, the arbitration fee and registration fee remitted shall not be reimbursed to the parties.
12. If a claim is relinquished before it is passed on to an arbitrator or arbitrators or if the dispute falls outside the jurisdiction of the Arbitration Court, the parties will be reimbursed 90% of the arbitration fee remitted, and no reimbursement will be offered for the registration fee. If a claim is relinquished after it is passed on to an arbitrator or arbitrators, no reimbursement will be offered for the arbitration or registration fees.
13. Fees shall be paid to the arbitrators within 30 days of the transfer of the material pertaining to the case to the Estonian Chamber of Commerce and Industry for safekeeping.
